Seminar: The “Two-Thirds Gender Principle” for Elected Bodies: How Did we Get Here, Where are we and where Might we be Going?

Prof. Yash Pal Ghai and Prof. Jill Cottrell Ghai are Kenyan academics in constitutional law. They are both Directors of the Katiba Institute which was set up to promote knowledge and understanding of Kenya’s Constitution and constitutionalism, and to defend and facilitate implementation of the Constitution. Ten years after the new constitution was adopted in Kenya, there is still no law guaranteeing achievement of the “two-thirds gender rule”. This presentation will focus on how we got here as a country despite the principle being included in the constitution. The seminar also discusses the historical prominent role of women in the constitution making process, where we are now and the possible “satisfactory” solutions. The presentation will further make a comparative analysis of Kenya and other countries in Africa and provide a platform to discuss whether we have a “constitutional crisis” and what this means for governance and development in Kenya.
